Blue Starr Drive, Claremore, OK 74017. These terms of use are entered into by and between You and HydroHoist. The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use”), govern your access to and use of the Websites, including any content, functionality and services offered on or through the Websites, whether as a guest or a registered user.
Please read the Terms of Use and our Privacy Policy (described below) before you start to use any Website. If you continue to browse and use any Website, you are agreeing to comply with and be bound by the Terms of Use, which together with our Privacy Policy govern our relationship with you in relation to the Websites. Additionally, you agree not to introduce any viruses, trojan horses, worms, logic bombs or other material which is malicious or technologically harmful; attack a Website via a denial-of-service attack or a distributed denial-of-service attack; or to otherwise attempt to interfere with the proper working of the Websites or the Resources.
Wherein, you understand that:
- In order to access our Resources, you may be required to provide certain information about yourself (such as identification, contact details, etc.) as part of the registration process, or as part of your ability to use the Resources. You agree that any information you provide will always be accurate, correct, and up to date. You agree that all information you provide to register with a Website, use the Resources, or otherwise, including but not limited to through the use of any interactive features on the Website, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

- Attempting to monitor, copy, duplicate, reproduce, sell, trade, or resell our Websites or Resources is strictly prohibited.
- You are solely responsible any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.
- We may provide various open communication tools on our Websites, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website (“User Content”), then it is your personal responsibility to use these tools in a responsible and ethical manner. We have the right at our sole discretion to remove any User Content that, we feel in our judgment does not comply with these Terms of Use, along with any content that we feel:
- Contains any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable.
- Promotes sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
- Infringes any patent, trademark, trade secret, copyright or other intellectual property or other rights of any other person.
- Violates the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Use or our Privacy Policy.
- Would be likely to deceive any person.
- Promotes any illegal activity, or advocate, promote or assist any unlawful act.
- Causes annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person.
- Impersonates any person, or misrepresent your identity or affiliation with any person or organization.
- Involves commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter or advertising.
- Gives the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.
or is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
- We do not assume any responsibility or liability for any User Content posted by you or any other 3rd party users of our website, including with respect to such User Content’s legality, reliability, accuracy or appropriateness. However, any User Content posted by you using any open communication tools on our website, provided that it doesn’t violate or infringe on any 3rd party copyrights or trademarks, becomes the property of HydroHoist, and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use our Resources. All information provided as part of our registration process is covered by our Privacy Policy.
You represent and warrant that:
- You own or control all rights in and to the User Content and have the right to grant the license granted above to us and our licensees, successors and assigns.
- All of your User Content does and will comply with these Terms of Use.
- You agree to indemnify and hold harmless HydroHoist, and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms of Use or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under these Terms of Use. In such event, you shall provide us with such cooperation as is reasonably requested by us.

vii) we cannot and do not guarantee or warrant that files available for downloading from the internet, the Websites or the Resources will be free of viruses or other destructive code.
You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. Limitation of Liability
in no event will HydroHoist, its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors be liable for damages of any kind, under any legal theory, arising out of or in connection with. In conjunction with the Disclaimer and Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. In no event will HydroHoist its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of your use, or inability to use, the Websites or the Resources, any websites or applications linked to them, any content on the Websites or the Resources or such other websites or applications or any services or items obtained through the Websites or the Resources or such other websites or applications, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, to the full extent that applicable limitation of liability laws apply.
Indemnification
You agree to defend, indemnify and hold harmless HydroHoist, its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Websites or the Resources, including, but not limited to, your User Content, any use of the Websites’ or the Resources’ content, services and products other than as expressly authorized in these Terms of Use or your use of any information obtained from the Websites or the Resources.
Intellectual Property Rights
The Websites and their entire contents, features and functionality (including but not limited to all Resources, information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by us, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
